Introduction

This document is an electronic record in terms of the Information Technology Act, 2000 and rules made thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of domain name [www.super.money] (“Website”), including the related mobile site and mobile application (hereinafter referred to as “Platform”).

The Platform is owned by Scapic Innovations Private Limited, a company incorporated under the Companies Act, 2013 with its registered office at Buildings Alyssa, Begonia & Clover, Embassy Tech Village, Outer Ring Road, Devarabeesanahalli Village, Bengaluru – 560103, Karnataka, India and its branch office at Ground Floor, Shilpita Tech Park, Outer Ring Road, Devarabeesanahalli Village, Bengaluru-560103, Karnataka, India (hereinafter referred to as &dquot;Scapic&dquot; or “super.money” or “SIPL”).

Your use of the Platform and services and tools are governed by the following terms and conditions (&dquot;Terms of Use&dquot;) as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. If You transact on the Platform, You shall be subject to the policies that are applicable to the Platform for such transaction. By mere use of the Platform, You shall be contracting with Scapic and these terms and conditions including the policies constitute Your binding obligations, with Scapic.

For the purpose of these Terms of Use, wherever the context so requires &dquot;You&dquot; or &dquot;User&dquot; shall mean any natural or legal person who has agreed to become a User on the Platform by providing Registration Data while registering on the Platform as Registered User using the computer systems. The term &dquot;We&dquot;, &dquot;Us&dquot;, &dquot;Our&dquot; shall mean Scapic Innovations Private Limited.

ACCESSING, BROWSING OR OTHERWISE USING THE SITE OR THE MOBILE APPLICATION INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING. By impliedly or expressly accepting these Terms of Use, You also accept and agree to be bound by Scapic Policies (including but not limited to Privacy Policy available at PRIVACY POLICY) as amended from time to time. These terms shall be in relation to and shall apply to all acts and/or omissions of Scapic and/or its affiliates, shareholders, their respective officers and employees, and any service providers or contractors in relation to the Services. Scapic reserves the right to modify or review the provisions in this terms without prior notice. Therefore, the Users shall periodically visit the Website for notices relating to amendments to these terms.

General Terms of Use

1. Eligibility

Transaction on the Platform is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are &dquot;incompetent to contract&dquot; within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Platform. If You are a minor i.e. under the age of 18 years, You may use the Platform or access content on the Platform only under the supervision and prior consent/ permission of a parent or legal guardian.

As a minor if You wish to transact on the Platform, such transaction on the Platform may be made by Your legal guardian or parents. Scapic reserves the right to terminate Your membership and / or refuse to provide You with access to the Platform if it is brought to Scapic's notice or if it is discovered that You are under the age of 18 years and transacting on the Platform.

You also warrant that You are not a 'Politically Exposed Person' in terms of the Master Direction - Know Your Customer (KYC) Directions, 2016 issued by the Reserve Bank of India (&dquot;RBI&dquot;), read with the Prevention of Money Laundering Act, 2002, as amended, modified or replaced from time to time (&dquot;KYC Framework&dquot;).

You must not be restricted by any legal, regulatory, judicial, quasi-judicial or other authority, to access the Platform or avail the services, including to enter into transactions contemplated using the services. You agree to use the services only for purposes that are permitted by these Terms and in accordance with applicable laws.

2. Definitions

&dquot;Applicable Law&dquot; – means all applicable laws, acts, rules, regulations, guidelines, orders, circulars, decrees, directives, judgements, notifications issued by any statutory or government authority including the rules, regulations, notifications and circulars issued by the Reserve Bank of India as well as the rules, regulations, roles, responsibilities and processes as defined by the National Payments Corporation of India, in each case, as may be modified, supplemented or replaced from time to time.

“EUPP” or “End User Permitted Purpose”

“Scapic Partners” – Shall refer to any individual, companies, sole proprietorships, bodies corporate, group of individuals or other legal entities defined under law with whom Scapic has a contractual relationship, including, but not limited to, Merchants, Advertisers, Deal partners, Financial institutions, switch interface partners.

“super.money App” or “App” – The mobile application(s), hosted by Scapic for providing services to its users, including service providers and also includes any and all services where it acts as an Intermediary.

“super.money Website” – Shall refer to www.super.money, which is registered by Scapic and used as a medium to communicate and inform users of services provided by Scapic, not limiting to its features, terms and conditions, Our contact details or provide services through thee website.

‘super.money Platform” or “Platform” – Refers to any platform owned/subscribed/used by Scapic Innovations Private Limited not limited to websites, mobile applications, devices, URLs/links, notifications, chatbot, or any other communication medium used by Scapic to provide its services to its Users.

“Service Providers” – Refers to any individual, companies, sole proprietorships, bodies corporate, group of individuals or other legal entities defined under law whose services are used by Scapic in order to provide the intended services to You through super.money Platform.

“Terms of use”/”Terms and Conditions”– are interchangeably used and shall have the same meaning.

“We”, “Us”, “Our” – shall refer to Scapic.

“You”, “Yours”, “Yourself”, “Scapic User” or “User” – refers to any non-registered individual, or registered user of Platform, including but not limited to Scapic customers.

3. Registration and Use of the Platform

To use the Platform, You may be required to register on the Platform by creating an account on the Platform. When You register You shall provide true, accurate and complete information. Any information that You provide shall be in accordance with Your latest and updated KYC, contact information and documents. Certain services provided by the Platform may require You to provide some additional information. You agree that Scapic may collect, store, use, process, otherwise deal with, and share Your information with its affiliates, group companies, Service Providers, Partners, service providers of Partners, Credit Information Companies, etc. in accordance with our Privacy Policy.

You agree that if any information provided by You is inaccurate, incomplete or not current or if we reasonably believe that the information provided by You is inaccurate, incomplete or not current, then Scapic reserves the right to indefinitely suspend, terminate or block Your account and Your access to the Platform or the services provided through the Platform.

To access the Platform and its services, You shall need a functional mobile phone, an internet connection that comply with certain minimum requirements. To use the Platform, on the App, You will need to register/login on a mobile phone. The mobile phone You use shall be Your registered device. You can access UPI through super.money app only through Your registered device. When You change Your device, the device that You login to shall become Your registered device.

You agree and acknowledge that the credentials for using or logging into the Platform are to be kept confidential and secure. Accordingly, You are solely responsible for all activities that occur in relation to Your credentials and Scapic shall not be responsible for any change, action, omission or anything in relation to any action performed using Your credentials on the Platform.

You agree, undertake and confirm that Your use of Platform shall be strictly governed by the following binding principles:

You shall not host, display, upload, modify, publish, transmit, update or share any information which:

  1. belongs to another person and to which You do not have any right to;
  2. is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; or unlawfully threatening or unlawfully harassing including but not limited to &dquot;indecent representation of women&dquot; within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986;
  3. is misleading in any way;
  4. is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual;
  5. harasses or advocates harassment of another person;
  6. involves the transmission of &dquot;junk mail&dquot;, &dquot;chain letters&dquot;, or unsolicited mass mailing or &dquot;spamming&dquot;;
  7. promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
  8. infringes upon or violates any third party's rights [including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address or phone number) or rights of publicity];
  9. promotes an illegal or unauthorized copy of another person's copyrighted work (see &dquot;Copyright complaint&dquot; below for instructions on how to lodge a complaint about uploaded copyrighted material), such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices;
  10. contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);
  11. provides material that exploits people in a sexual, violent or otherwise inappropriate manner or solicits personal information from anyone;
  12. provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
  13. contains video, photographs, or images of another person (with a minor or an adult);
  14. tries to gain unauthorized access or exceeds the scope of authorized access to the Platform or to profiles, blogs, communities, account information, bulletins, friend requests, or other areas of the Platform or solicits passwords or personal identifying information for commercial or unlawful purposes from other users;
  15. engages in commercial activities and/or sales without Our prior written consent such as contests, sweepstakes, barter, advertising and pyramid schemes, or the buying or selling of &dquot;virtual&dquot; products related to the Platform. Throughout this Terms of Use, Scapic's prior written consent means a communication coming from Scapic's Legal Department, specifically in response to Your request, and specifically addressing the activity or conduct for which You seek authorization;
  16. solicits gambling or engages in any gambling activity which We, in Our sole discretion, believes is or could be construed as being illegal;
  17. interferes with another User’s use and enjoyment of the Platform or any other individual's User and enjoyment of similar services;
  18. refers to any Platform or URL that, in Our sole discretion, contains material that is inappropriate for the Platform or any other Platform, contains content that would be prohibited or violates the letter or spirit of these Terms of Use;
  19. harms minors in any way;
  20. infringes any patent, trademark, copyright or other proprietary rights or third party's trade secrets or rights of publicity or privacy or shall not be fraudulent or involve the sale of counterfeit or stolen products;
  21. violates any law for the time being in force;
  22. deceives or misleads the addressee/users about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
  23. impersonates another person;
  24. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal information;
  25. threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offense or prevents investigation of any offense or is insulting any other nation;
  26. shall not be false, inaccurate or misleading;
  27. shall not, directly or indirectly, offer, attempt to offer, trade or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force;
  28. shall not create liability for Us or cause Us to lose (in whole or in part) the services of Our internet service provider (&dquot;ISPs&dquot;) or other Partners and/or Service Providers;
  29. You shall not use any &dquot;deep-link&dquot;, &dquot;page-scrape&dquot;, &dquot;robot&dquot;, &dquot;spider&dquot; or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Platform or any content, or in any way reproduce or circumvent the navigational structure or presentation of the Platform or any content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Platform. We reserve Our right to bar any such activity;
  30. You shall not attempt to gain unauthorized access to any portion or feature of the Platform, or any other systems or networks connected to the Platform or to any server, computer, network, or to any of the services offered on or through the Platform, by hacking, password &dquot;mining&dquot; or any other illegitimate means;
  31. You shall not probe, scan or test the vulnerability of the Platform or any network connected to the Platform nor breach the security or authentication measures on the Platform or any network connected to the Platform. You may not reverse look-up, trace or seek to trace any information on any other User of or visitor to Platform, or any other customer, including any account on the Platform not owned by You, to its source, or exploit the Platform or any service or information made available or offered by or through the Platform, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than Your own information, as provided for by the Platform;
  32. You shall not make any negative, denigrating or defamatory statement(s) or comment(s) about Us or the brand name or domain name used by Us including the terms Scapic, Super Money, or any trademarks owned by Scapic, or otherwise engage in any conduct or action that might tarnish the image or reputation of Scapic or its Partners on the platform or otherwise tarnish or dilute any Scapic’s trade or service marks, trade name and/or goodwill associated with such trade or service marks, trade name as may be owned or used by us. You agree that You will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Platform or Scapic’s systems or networks, or any systems or networks connected to Scapic;
  33. You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Platform or any transaction being conducted on the Platform, or with any other person's use of the Platform;
  34. You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal You send to Us on or through the Platform or any service offered on or through the Platform. You may not pretend that You are, or that You represent, someone else, or impersonate any other individual or entity;
  35. You may not use the Platform or any content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of Scapic and/or others;
  36. You shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules thereunder as applicable and as amended from time to time and also all applicable Domestic laws, rules and regulations (including the provisions of any applicable Exchange Control Laws or Regulations in Force) and International Laws, Foreign Exchange Laws, Statutes, Ordinances and Regulations (including, but not limited to Sales Tax/VAT, Income Tax, Octroi, Service Tax, Central Excise, Custom Duty, Local Levies) regarding Your use of Our service and Your listing, purchase, solicitation of offers to purchase, and sale of products or services. You shall not engage in any transaction in an item or service, which is prohibited by the provisions of any applicable law including exchange control laws or regulations for the time being in force;
  37. Solely to enable Us to use the information You supply Us with, so that we are not violating any rights You might have in Your Information, You agree to grant Us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to exercise the copyright, publicity, database rights or any other rights You have in Your Information, in any media now known or not currently known, with respect to Your Information. We will only use Your information in accordance with the Terms of Use and Privacy Policy applicable to use of the Platform;
  38. From time to time, You shall be responsible for providing information relating to the products or services proposed to be sold by You. In this connection, You undertake that all such information shall be accurate in all respects;
  39. You may not transmit any chain letters or unsolicited commercial or junk email to other Users via the Platform. It shall be a violation of these Terms of Use to use any information obtained from the Platform in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to another person other than Us without Our prior explicit consent. In order to protect Our Users from such advertising or solicitation, We reserve the right to restrict the number of messages or emails which a user may send to other Users in any 24-hour period which We deem appropriate in its sole discretion. You understand that We have the right at all times to disclose any information (including the identity of the persons providing information or materials on the Platform) as necessary to satisfy any law, regulation or valid governmental request. This may include, without limitation, disclosure of the information in connection with investigation of alleged illegal activity or solicitation of illegal activity or in response to a lawful court order or subpoena. In addition, We can (and You hereby expressly authorize Us to) disclose any information about You to law enforcement or other government officials, as we, in Our sole discretion, believe necessary or appropriate in connection with the investigation and/or resolution of possible crimes, especially those that may involve personal injury.

You further agree that –

  • You will use the services of Platform solely in accordance with Applicable Law
  • In the event of any dispute, Scapic’s records shall be binding as the conclusive evidence of the transactions carried out through use of Scapic’s Services.
  • Scapic shall send all customer communications by SMS and/or email and they shall be deemed to have been received by You after they have been submitted for delivery to the SMS/email service providers.
  • Agree to receive all commercial messages including transactional messages and/or promotion messages from Scapic or its Service Providers/Partners.
  • You would be solely responsible for payment of any taxes, duties or other governmental levies or any financial charges that may be imposed on any products or services purchased or supplied by a Merchant or otherwise arising from online transactions.
  • ensure that the Scapic Services are not used for transactions in foreign currency, unless permitted for any PhonePe Service.

4. VIOLATION OF TERMS OF USE

In the event You do not comply with these terms or any part thereof as determined by Us in our sole discretion which determination shall be final and binding, we reserve the right to terminate, suspend, block Your account or Your access to the Platform and/or any or all services provided through or by the Platform without notice.

If we have a reason to believe that You are engaged in illegal or suspicious activity, we may block Your account, transactions or reverse any transactions conducted by You through the Platform.

If we suspect that You are:

  1. using the Platform in a manner that is disingenuous (for example: making transactions to earn undue rewards) or in a manner that is not intended to be used or accessed;
  2. that purports to artificially increase (or decrease) Your transaction volume or usage of the App
  3. that is designed to deliberately side step fair use restrictions;
  4. that may result in You gaining an undue, unfair or unethical advantage over other Users or Partners;
  5. that is intended to cause losses or other harm to Partners,

then we may block Your account, transactions or reverse any transactions conducted by You through the Platform.

5. TERMINATION OR DELETION OF YOUR ACCOUNT

You may terminate Your agreement with these terms by discontinuing the use of the Platform or its services or discontinuing the access to the Platform or its services. However, this shall not affect Your liability or responsibility, if any, that have arisen during the use or access of the Platform or the services. We are not able to delete Your account as we are required to maintain records of Your transactions under Applicable Law. However, You may deactivate Your account by logging off from the super.money App.

6. FEES

You are responsible for any fees that may be applicable to certain transactions or use of the Platform; where You will be notified of such applicable fees, prior to the completion of any transaction. By clicking ‘Proceed’ / ‘Submit’ / ‘Continue’ or any other similar button on the Platform, You shall be deemed to have consented to the fees displayed on the said page.

7. PRIVACY

We collect, hold, use and transfer Your personal data in accordance with our Privacy Policy. By agreeing to the Terms of Use, You also hereby agree to our Privacy Policy, which may be updated and/or modified by us from time to time. You understand and agree that, to the extent permitted by applicable law, any data provided by You in connection with the services provided by Scapic, may be shared with our subsidiaries, affiliates or partners, and/ or used by us for enhancing the Platform, including but not limited to creating new products. Please refer to the Privacy Policy for further clarity on the subject.

8. DISCLAIMER

THE PLATFORM, INCLUDING ALL CONTENT, SOFTWARE, FUNCTIONS, MATERIALS, AND INFORMATION MADE AVAILABLE ON, PROVIDED IN CONNECTION WITH OR ACCESSIBLE THROUGH THE PLATFORM, ARE PROVIDED ON AN &dquot;AS IS&dquot; AND “AS AVAILABLE’ BASIS. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, SCAPIC AND ITS GROUP COMPANIES AND THEIR AGENTS, SERVICE PROVIDERS, PARTNERS, CO-BRANDING PARTNERS MAKE NO REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED OF ANY KIND WHATSOEVER FOR THE PLATFORM, SERVICES OR THE CONTENT, MATERIALS, INFORMATION AND FUNCTIONS MADE ACCESSIBLE BY THE SOFTWARE USED ON OR ACCESSED THROUGH THE PLATFORM, OR FOR ANY BREACH OF SECURITY ASSOCIATED WITH THE TRANSMISSION OF SENSITIVE INFORMATION THROUGH THE PLATFORM. SCAPIC AND ITS AFFILIATES DISCLAIM WITHOUT LIMITATION, ANY WARRANTY OF ANY KIND WITH RESPECT TO THE PLATFORM, NONINFRINGEMENT OF PROPRIETARY RIGHTS, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. SCAPIC DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE. SCAPIC SHALL NOT BE RESPONSIBLE FOR ANY SERVICE INTERRUPTIONS, INCLUDING BUT NOT LIMITED TO SYSTEM FAILURES OR OTHER INTERRUPTIONS THAT MAY AFFECT THE RECEIPT, PROCESSING, ACCEPTANCE, COMPLETION OR SETTLEMENT OF PAYMENT TRANSACTIONS, P2P PAYMENTS OR THE SERVICES.

You further understand, agree and acknowledge that:

  1. Scapic does not provide any warranty/guarantee for the Services and does not warrant that its Services will be as per any prescribed standards or prudent practices adopted in the industry.
  2. You understand that Scapic is not a lending institution and does not offer any form of loans and merely provides facilitation and management services.
  3. You also understand that Scapic is not involved in the handling of funds when using UPI.
  4. Scapic provides its Platform and its services in accordance with Applicable Laws and at its sole discretion has the right to terminate, suspend, modify, restrict, discontinue, delete the Platform, the services or any part thereof without notice.
  5. The Platform is subject to certain limitations, such as, limitations on server storage space, etc. You understand and agree to use the Platform at his/her own risk and liability and agree not to hold Scapic liable for any liability, financial or otherwise.
  6. The Platform may be linked to the website of third parties, affiliates and business partners. Scapic has no control over, and shall not be liable or responsible for any content, accuracy, validity, reliability, quality of such websites or made available by/through its Platform. Inclusion of any link on the Platform does not imply that Scapic endorses the linked site. The Users understand that they use and access the links and these services at his/her own risk.

9. INDEMNITY

You shall indemnify and hold harmless Scapic, its affiliates, its group companies, their officers, shareholders, subsidiaries, associate companies, directors, employees and agents, Partners, co-branding partners, licensors, licensees, consultants, or contractors be liable to You or any third party, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, Privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

10. LIMITATION OF LIABILITY

In no event shall Scapic, its affiliates, its group companies, their officers, shareholders subsidiaries, associate companies, directors, employees and agents, Partners, co-branders, licensors, licensees, consultants, or contractors be liable to You or any third party for any special, incidental, indirect, consequential or punitive damages or losses whatsoever, or damages for loss of data or profits, goodwill, and/ or other intangible loss, whether or not foreseeable and regardless of whether Scapic has been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection with Your use of, or access to, the Platform, App or services.

In no event shall Scapic’s total cumulative liability to You in connection with the Platform or any services for all damages, losses and causes of action (whether arising under contract or otherwise), arising from or relating to Your use of the Platform or arising from these Terms of Use exceed INR 100 (Indian Rupees hundred only).

You and Scapic acknowledge that each party has entered into these terms relying on the limitations of liability stated herein and that those limitations are an essential basis of the bargain between the parties. In addition to and without limiting any of the foregoing, Scapic shall have any liability for any failure or delay resulting from any condition beyond the reasonable control of such party, including but not limited to governmental action or acts of terrorism, earthquake, fire, flood or other acts of God, labor conditions, power failures and Internet disturbances.

11. DISPUTES, GOVERNING LAW AND JURISDICTION

These Terms shall be governed, interpreted, and construed in accordance with the laws of India, without regard to the conflict of law provisions and for resolution of any dispute arising out of Your use of the Services or in relation to these Terms. Notwithstanding the foregoing, You agree that (i) Scapic has the right to bring any proceedings before any court/forum of competent jurisdiction and You irrevocably submit to the jurisdiction of such courts or forum; and (ii) any proceeding brought by You shall be exclusively before the courts in Bengaluru, India.

12. INTELLECTUAL PROPERTY RIGHTS

Scapic’s logos, brand names, devices, etc. are protected by copyright, trademarks, patents, trade secret and/or other intellectual property laws. No information, content or material from the Platform including, without limitation, all of the page headers, images, illustrations, graphics, audio clips, video clips or text, reports generated, trademarks, trade names may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way without Our express written permission. You are hereby given a limited license to use the Platform, subject to Your agreement of these Terms of Use

Scapic and its licensors, if any, are the sole owners of the underlying software and source code associated with the Platforms as well as any other intellectual property rights of any other nature associated with the Platforms and their content.

When You upload, submit, store, send or receive content that may include feedback to or through the Platform, You give Scapic a worldwide, perpetual license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display and distribute such content. This license shall not expire even if it is not used by Scapic. The rights You grant in this license are for the limited purpose of operating, promoting, and improving the Platform Services, and to develop new ones. This license continues even if You stop using the Platform.

13. MISCELLANEOUS

Force Majeure: You agree that Scapic shall be under no liability whatsoever to You in the event of non-availability of the Platform and/or any of the Services or any portion thereof, occasioned by an Act of God, war, disease, revolution, riot, civil commotion, strike, lockout, flood, fire, satellite failure, failure of any public utility, man-made disaster, satellite failure or any other cause whatsoever beyond the control of Scapic (including any event which is caused by the failure or non-performance on the part of the Content Owners or the Platform Partners).

Severability: If any provision of these Terms is held invalid, void, or unenforceable, then that provision shall be considered severable from the remaining provisions, and the remaining provisions shall be given full force and effect. Amendments: We may revise these Terms from time to time, without prior notice to You, to update, revise, supplement, and otherwise modify these Terms and to impose new or additional rules, policies, terms, or conditions on Your use of the Service. Any updates, revisions, supplements, modifications, and additional rules, policies, terms, and conditions will be posted on the Platform and will be effective immediately after such posting and we recommend that You periodically check these Terms on the Platform for such revised terms. Your continued use of the Services and/or the Platform will be deemed to constitute Your acceptance of any and all such revised terms.

Entire agreement: These Terms, the Privacy Policy and any other terms or policies as may be prescribed by Scapic from time to time, constitute the entire agreement between You and Scapic, which will govern Your use of or access to the Services and/or the Platform, superseding any prior agreements between You and Scapic regarding such use or access. Survival: You acknowledge that Your representations, undertakings, and warranties and the clauses relating to indemnities, limitation of liability, grant of license, governing law shall survive the efflux of time and the termination of these Terms)

B. TERMS GOVERNING SUPER.MONEY UPI

This document is an electronic record in the form of an electronic contract formed under Information Technology Act, 2000 and Rules made thereunder and the amended provisions pertaining to electronic documents / records in various statutes as amended by the Information Technology Act, 2000. This document shall be read in conjunction with super.money Terms of Use (“ToU”) and Privacy Policy. By availing super.money UPI, You agree to be bound by these terms governing Your use of super.money UPI (‘UPI Terms’)

What is NPCI?
National Payments Corporation of India (NPCI) is a payment system operator authorised by RBI. NPCI owns and operates the UPI payment system.

What is PSP bank?
PSP is the banking company authorized to act as a Payment Service Provider (PSP) under the UPI framework. PSP engages the TPAP to provide UPI services to the end-user customers.

What are TPAPs?
Third Party Application Provider (TPAP) is an entity that provides the UPI compliant app(s) to the end-user customers to facilitate UPI based payment transactions.

What is Customer’s Bank?
The Bank where the end-user customer maintains his/her account that has been linked for the purpose of debiting/crediting the payment transactions made through UPI.

Who is End User Customer?
The end-user customer is the individual who uses UPI payment facility to send and receive payments.

Roles & Responsibilities of NPCI

  1. NPCI owns and operates the Unified Payments Interface (UPI) platform
  2. NPCI prescribes rules, regulations, guidelines, and the respective roles, responsibilities and liabilities of the participants, with respect to UPI. This also includes transaction processing and settlement, dispute management and clearing cut-offs for settlement.
  3. NPCI approves the participation of Issuer Banks, PSP Banks, Third Party Application Providers (TPAP) and Prepaid Payment Instrument issuers (PPIs) in UPI
  4. NPCI provides a safe, secure and efficient UPI system and network
  5. NPCI provides online transaction routing, processing and settlement services to members participating in UPI
  6. NPCI can, either directly or through a third party, conduct audit on UPI participants and call for data, information and records, in relation to their participation in UPI
  7. NPCI provides the banks participating in UPI access to system where they can download reports, raise chargebacks, update the status of UPI transactions etc.

Roles & Responsibilities of PSP Bank

  1. PSP Bank is a member of UPI and connects to the UPI platform for availing UPI payment facility and providing the same to the TPAP which in turn enables the end-user customers / merchants to make and accept UPI payments.
  2. PSP Bank, either through its own app or TPAP’s app, on-boards and registers the end-user customers on UPI and links their bank accounts to their respective UPI ID.
  3. PSP Bank is responsible for authentication of the end-user customer at the time of registration of such customer, either through its own app or TPAP’s app
  4. PSP Bank engages and on-boards the TPAPs to make the TPAP’s UPI app available to the end-user customers
  5. PSP Bank has to ensure that TPAP and its systems are adequately secure to function on UPI platform
  6. PSP Bank is responsible to ensure that UPI app and systems of TPAP are audited to safeguard security and integrity of the data and information of the end-user customer including UPI transaction data as well as UPI app security
  7. PSP Bank has to store all the payments data including UPI Transaction Data collected for the purpose of facilitating UPI transactions, only in India
  8. PSP Bank is responsible for giving all UPI customers an option to choose any bank account from the list of Banks available on UPI platform for linking with the customer’s UPI ID.
  9. PSP Bank is responsible to put in place a grievance redressal mechanism for resolving complaints and disputes raised by the end-user customer

Roles & Responsibilities of TPAP (super.money)

  1. TPAP is a service provider and participates in UPI through PSP Bank
  2. TPAP is responsible to comply with all the requirements prescribed by PSP Bank and NPCI in relation to TPAP’s participation in UPI
  3. TPAP is responsible to ensure that its systems are adequately secure to function on the UPI platform
  4. TPAP is responsible to comply with all applicable laws, rules, regulations and guidelines etc. prescribed by any statutory or regulatory authority in relation to UPI and TPAP’s participation on the UPI platform including all circulars and guidelines issued by NPCI in this regard
  5. TPAP has to store all the payments data including UPI Transaction Data collected by TPAP for the purpose of facilitating UPI transactions, only in India
  6. TPAP is responsible to facilitate RBI, NPCI and other agencies nominated by RBI/ NPCI, to access the data, information, systems of TPAP related to UPI and carry out audits of TPAP, as and when required by RBI and NPCI
  7. TPAP shall facilitate the end-user customer with an option to raise grievance through the TPAP’s grievance redressal facility made available through TPAP’s UPI app or website and such other channels as may be deemed appropriate by the TPAP like email, messaging platform, IVR etc.

Dispute Redressal Mechanism

  1. Every end-user customer can raise a complaint with respect to a UPI transaction, on the PSP app / TPAP app.
  2. End-user customer can select the relevant UPI transaction and raise a complaint in relation thereto
  3. A complaint shall be first raised with the relevant TPAP in respect to all UPI related grievances / complaints of the end-user customers on-boarded by the PSP Bank / TPAP (if the UPI transaction is made through TPAP app). In case the complaint / grievance remains unresolved, the next level for escalation will be the PSP Bank, followed by the bank (where the end-user customer maintains its account) and NPCI, in the same order. After exercising these options, the end-user customer can approach the Banking Ombudsman and / or the Ombudsman for Digital Complaints, as the case may be.
  4. The complaint can be raised for both the types of transactions i.e. fund transfer and merchant transactions.
  5. The end-user customer shall be kept communicated by the PSP / TPAP by means of updating the status of such end-user customer’s complaint on the relevant app itself

Terms and Conditions

By using the Scapic Innovations Pvt. Ltd (“Scapic”) UPI facility feature on super.money (“Platforms”), You give Your consent and agree to all the terms and conditions mentioned herein below. Please read these terms and conditions carefully before proceeding:

  1. You understand that Scapic is only the Third-Party Application Provider of payments transactions initiated by You and is not a party to the payments nor monitors or have any control on how the UPI Facility are provided by the PSP Bank in integration with NPCI UPI Ecosystem.
  2. You understand and agree that the UPI ecosystem is solely controlled and governed as per the rules, regulations and/or circulars prescribed by NPCI.
  3. You understand and agree that in order to avail the UPI facility, users will have to be registered for the UPI Facility as per the discretion of the PSP Bank, NPCI and RBI. However, acceptance of the registration of the user for availing the UPI Facility is the sole discretion of NPCI.
  4. You understand and agree that in order to avail the UPI facility, users will be available to eligible users having a satisfactorily running Savings/Current/Overdraft account with any Bank onboarded or registered under the UPI ecosystem with NPCI.
  5. You hereby agree to adhere to the transactional limits and the terms prescribed by NPCI or respective PSP/Remitter bank.
  6. You represent and warrant that You are at least 18 years of age and have not been previously suspended or removed by Scapic or any of its affiliates, or disqualified for any other reason, from availing the Scapic UPI facility or using the Scapic’s SuperMoney Platform.
  7. You represent and warrant that You have the right, authority and capacity to enter into this Agreement and to abide by all the T&Cs as part of this Agreement.
  8. You shall not impersonate any person or entity, or falsely state or otherwise misrepresent Your identity, age or affiliation with any person or entity.
  9. You agree that in the event of any violation of the T&Cs, Scapic reserves the right to suspend or permanently prevent You from availing Scapic UPI Facility.
  10. By proceeding with the Scapic UPI facility the Customer agree and are bounded by –
    • the Terms of Use, User Agreement, Standard Terms and Conditions of the Scapic Platform and other relevant documentation including any modifications, alterations or updates thereof, that are published on the Platform including any modifications, alterations or updates that Scapic and/or bank makes.; and
    • Scapic’s privacy policy
    • all the terms and conditions of NPCI UPI Ecosystem
    • all the terms and conditions of the Product as specified on the product page.
    • all applicable terms and conditions of the Bank (including the specific terms and
    • conditions for the availing of the Scapic UPI facility as mentioned above.
  11. The Customer understand and agree to release and hold Scapic harmless from and against any claims, damages, or liability of any kind, or any direct, indirect, consequential, incidental or other damages, which the Customer or anyone else may suffer as a result of opting for Scapic UPI facility for purchasing of Product on Scapic Platform.
  12. Scapic hereby excludes and disclaims all liabilities, whether direct or indirect, that may arise while availing Scapic UPI facility.
  13. Scapic shall not be responsible or liable for any loss or damage, howsoever caused or suffered by the Customer while availing the Scapic UPI facility as a payment option.
  14. Customers understand and agree to indemnify and keep Scapic harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney & court fees) that may be suffered by Scapic as a consequence of (i) violation of the terms of this Policy by the customer; (ii) violation of applicable laws; (iii) any action or inaction resulting in willful misconduct or negligence on the Customer’s part.
  15. Scapic is only a third-party application provider of UPI facility and does not provide UPI services which are ultimately provided by NPCI in integration with the PSP Bank. Scapic is not a warrantor, insurer, or guarantor of the UPI services to be provided by the NPCI. Any disputes regarding the transaction must be handled directly between the Customer and the customer’s bank. Scapic will not be responsible for any failures/ technical issues (including transactional failures/ issues) on the part of any NPCI or PSP bank.
  16. Scapic enables/facilitates its customers to make the UPI facility. If the customer proceeds to make payment for using UPI Facility, the same will not be construed as a purchase of service through Scapic.

Customer Redressal Mechanism

Customer hereby understands that Scapic Innovations Pvt. is a TPAP authorized by NPCI to facilitate payments through PSP Bank(s). Customer understands that we are a service provider, and we participate in UPI through the PSP Bank.

Customer hereby understands that Scapic Innovations Pvt Ltd is bound by the tripartite agreement entered with the sponsor PSP Bank i.e. Yes Bank and NPCI. Scapic Innovations Pvt Ltd shall be responsible for facilitating grievances / complaints resolution of the customers on-boarded on our UPI application.

Scapic Innovations Pvt Ltd shall be the first point of contact for all UPI related grievances/complaints for customers on-boarded by us. In case the complaint/grievance remains unresolved, the next level for escalation will be the PSP Bank, followed by the bank (where You maintain the account) and NPCI in the same order. After exercising these options, customers can approach the Banking Ombudsman and / or the Ombudsman for Digital Complaints, as the case may be.

Customers can raise a complaint with respect to a UPI facility on the complaint portal of Scapic UPI platform or Yes Bank Homepage. Customers can select the relevant transaction and appropriate reason to raise a complaint in relation thereto. A complaint reference number will be generated against the complaint raised.

The complaint can be raised about both the types of transactions i.e. fund transfer and merchant transactions. Please note-

  • Complaints raised through this link are resolved by NPCI.
  • Scapic and the PSP Bank will not be sending any notification when the complaint gets resolved. Customers can track the status of the complaint based on the complaint reference number.
  • The customer will be kept communicated by the PSP / TPAP by means of updating the status of such customer’s complaint on the relevant app itself.
  • Scapic shall not be responsible/liable for any complaint raised by the Customer on the Scapic UPI Portal.

To use super.money UPI, You shall ensure that:

  1. Link Correct Bank Account: Ensure You link the correct bank account and have the authority to operate it for UPI transactions.
  2. Update Mobile Number: Update Your mobile number with the bank in case of any changes.
  3. Confidentiality: Keep Your OTP, UPI PIN and bank account details confidential. Unauthorized usage due to sharing Your details will not be the responsibility of super.money.
  4. Payment Instruction Accuracy: You are responsible for the accuracy, authenticity, and completeness of payment instructions, including beneficiary details and VPAs. We will not verify this information independently.
  5. Binding Payment Instructions: Payment instructions issued by You are binding once accepted by Us.
  6. Truthful Information: Provide true, accurate, current, and complete information. If You fail to do so or if We suspects inaccuracies, We may suspend or terminate Your access to UPI services.
  7. No Liability for Delays or Errors: Neither We nor any UPI participant is liable for delays or losses due to errors in executing fund transfers. Ensure sufficient funds in Your bank account to avoid transaction declines.
  8. Authorization for Debit/Credit: You authorize debits or credits to Your bank account as per the payment instructions received from You.
  9. Lawful Use: Use UPI services only for lawful purposes. We reserve the right to monitor high risk transactions to ensure compliance with Applicable Laws.
  10. UPI Framework Compliance: Acknowledge that UPI services on the Portal are subject to the UPI Framework, which may change over time.
  11. Right to Suspend Account: If You provide false or incomplete information or violate the Terms of Use, super.money has the right to suspend or terminate Your account access.
  12. No Liability for Transfer Delays: super.money UPI, PSP, or any UPI system participant is not liable for delays or errors in fund transfers caused by You.

TERMS GOVERNING LOANS THROUGH SUPER.MONEY

This document is an electronic record in the form of an electronic contract formed under Information Technology Act, 2000 and Rules made thereunder and the amended provisions pertaining to electronic documents / records in various statutes as amended by the Information Technology Act, 2000. This document shall be read in conjunction with super.money Terms of Use (“ToU”) and Privacy Policy. By availing personal loan through super.money, You agree to be bound by these terms governing Your use of super.money UPI (‘Loan ToUs’).

Scapic does not loan or lend any money to You. We are merely a facilitator between You and Lending Partners.

By availing personal loans (‘Credit Facilities’) through super.money,

  1. You hereby undertake that You will not:
    • Use the proceeds of the Credit Facilities for any purpose other than as declared to the financial institutions who have partnered with Scapic for provision of loans and other credit facilities (“Credit Facilities”) to You (“Lending Partners”);
    • Accept or attempt to receive the Credit Facility in the form of cash or any other means;
    • Use the super.money in violation of applicable law or these Terms; or violate or attempt to violate any terms that apply to You or act in a manner that is fraudulent, malicious, or otherwise prejudicial to Scapic’s reputation, and direct or indirect interests.
    • hold Scapic liable for any loss of profits, loss of goodwill, or opportunity, or special, direct, indirect, incidental, punitive, or consequential damages of any kind whatsoever.
  2. You understand that Scapic is only an intermediary and owns and operates the App for facilitating the provision of Credit Facilities offered by Lending Partners to You. Scapic performs these services as a lending service provider to the Lenders and does not provide any financial services to You.
  3. You understand and agree that Scapic will use the information You provide, which is stored and collected, for lawful purposes in accordance with the Scapic privacy policy. This includes fulfilling internal operations, fulfilling requests, assisting in the completion of online personal loan submissions, and improving, developing, or providing services associated with Credit Facilities provided by Scapic.
  4. You authorize Scapic to collect and store Your details such as personal details, PAN card details, gender, and date of birth for processing personal loan offers. You further authorize Scapic to share this information with its Lending Partners for the issuance of personal loan facilities and associated services. Scapic will store this information according to the data retention clause in the Scapic privacy policy. We use Your personal data collected as part of the personal loan application for the following purposes:
    • to help facilitate Your application for Credit Facility by sending the information to Your Credit Information,
    • for the purposes of Credit Facility analytics,
    • to take up or investigate any complaints/ claims/ disputes
    • to monitor and review products and services from time to time,
    • to undertake financial/ regulatory/ management reporting and create and maintain various risk management models and
    • to conduct audits and for record keeping purposes.
  5. You agree and consent to Scapic’s Lending Partners sharing Your information and data (such as loan application status, approved loan amount, ROI, NACH status, KYC status, and loan disbursal status) with Scapic for the purpose of processing loan offers, including the loan amount and EMI details.
  6. You agree that Scapic’s Lending Partners have the sole discretion to approve the personal loan and can reject any personal loan application at their sole discretion. You understand that Scapic will not be held liable for any disputes or issues arising from the rejection of a loan application. On receipt of the loan application, the decision on whether a Credit Facility will be provided to You solely vests with the Lending Partner. Accordingly, the Lending Partner may accept or reject a loan application at its sole discretion without any obligations to clarify the reasons for its decision.
  7. You agree to indemnify and keep Scapic harmless against all damages, liabilities, costs, expenses, claims, suits, and proceedings (including reasonable attorney fees) that Scapic may suffer as a consequence of
    • Your violation of the terms of this policy;
    • Your violation of applicable laws; or
    • any action or inaction resulting in willful misconduct or negligence on Your part.
  8. You understand that Scapic will revoke access to Your data upon receiving Your request to revoke consent to use Your data. You can request the revocation of consent to use Your data by writing to support@super.money.
  9. You understand that except for the services explicitly provided, Scapic does not provide, control or endorse any third-party information, products or services in any manner whatsoever, even if such third party information, products or services are advertised on the Platform.
  10. You understand that Scapic may modify the services as well as the App on account of the changes to the Applicable law. You agree that in such a case if You become incapable of using all or any part the App or the services offered, Scapic shall not be responsible for the same.
  11. If You avail services from the Lending Partners through the Platform or the App, please refer to the privacy policy of the Lending Partners. You understand that Your relationship with the Lending Partners is governed solely by privacy policy, and loan agreements executed between You and the Lending Partners. In such cases, You are contracting directly with the Lending Partners. We accept no responsibility for the provision of Credit Facilities or its consequences. We are not liable for any losses that may occur as a result of the acts or omissions of the Lending Partners.
  12. You understand that Scapic accepts no responsibility for the provision of Credit Facilities or its consequences. Scapic cannot be held liable for any losses that may occur as a result of the acts or omissions of the Lending Partner.

The Credit Facilities:

  1. The terms and features of the Credit Facilities may vary across different Credit Facilities, Lending Partners, and borrowers. Please reach out to the Lending Partner for further details.
  2. Your ability and eligibility to avail the Credit Facilities may be based on various factors such as policies of our Lending Partners, market influences, etc. At the time of considering Your loan application/request, Super.money and/or its Lending Partner(s) may cross-check Your records with any information available in their own records or those of the Credit Information Companies (‘CICs;), fraud prevention agencies, collection agencies, or other third-party vendors for assessing Your creditworthiness, verifying Your identity, to prevent and detect crime and money laundering.
  3. Lending Partners have the right, and legal obligation, to report Your details and those of the Credit Facilities availed by You to the CICs. Missed/delayed payments will also be reported to the CICs.
  4. Lending Partners may retrieve/procure Your KYC data from the Central KYC registry for the purposes of KYC due diligence under the applicable laws. You hereby allow them to do so and further share these details with Super.money for providing Super.money Services.

You hereby consent to be contacted by Scapic and/or its associates/subsidiaries/affiliates, including but not limited to the collection agency, for important advice, services, operational alerts, collection activities, and communications critical to the Service through all the communication channels, including but not limited to telephone, emails, SMS, WhatsApp.

Check Your Credit Score

By using the ‘Check Your Credit Score’ functionality, You agree and acknowledge that You:

  1. Have requested for Your credit information;
  2. Have provided Your consent to appoint Scapic as Your authorised representative for verifying Your identity and sharing the details provided by You to Scapic with Experian (a credit bureau), as requested from time to time, and obtain Your Credit Information for End User Permitted Purpose;
  3. Have authorised Scapic to retain and store Your credit information till a) such time Your credit information is required for End User Permitted Purpose, c) a limited period of 6 months, d) You withdraw Your consent to store/use Your credit information with Scapic whichever is earlier;

TERMS GOVERNING SUPER.MONEY REWARDS

This document is an electronic record in the form of an electronic contract formed under Information Technology Act, 2000 and Rules made thereunder and the amended provisions pertaining to electronic documents / records in various statutes as amended by the Information Technology Act, 2000. This document shall be read in conjunction with super.money Terms of Use (“ToU”) and Privacy Policy. These terms are applicable to any rewards made available to You by or through super.money.

You understand that any such cashback or reward provided by us is a promotional activity which we may decide to withdraw or change from time to time at our sole and absolute discretion. You also understand that the cashback or reward cannot be claimed as a matter of right. Some rewards may be available only in specified geographies or for specified time duration.

super.money at its sole and absolute discretion shall decide the users who are eligible to participate in this campaign and earn cashbacks or rewards.

Rewards may be of various types including but not limited to cashback, SuperRewards, Raffle Rewards, or other such promotions (‘Promotions’).

Super.money may award You with rewards in recognition of Your regular and continuous use of super.money.

The rewards and Promotions are not a payment medium or payment instrument.

At no point can You purchase rewards such as SuperRewards or tickets for Raffle Rewards using real world money, to enter Promotions. None of the reward promotions include betting or wagering of real-world money. These rewards and promotions are also not a form of real-world money and at no point can they be exchanged for real-world money.

At no point can the rewards credited to Users or rewards pending credit to Users can be issued to, purchased by, sold to or otherwise transferred to any other person.

Where the rewards or prizes are in the nature of coupons or vouchers or cashback that can be utilized only with certain partners (‘superRewards’), You must contact the Partner offering the coupon or voucher for any customer support or queries.

The Partners can modify the terms and conditions of the redemption of SuperRewards at any time without notice to the User. Scapic is not responsible for informing You of any such changes. Scapic has no liability for the acts and omissions of the Partners.

At no point can the SuperRewards be transferred to other Users.

We reserve the right to deactivate or delete Your account, all related information on it, and forfeit all Rewards or related prizes, in the event of misuse of the offer, fraud or suspicious transaction/activity on the super.money app or any other super.money Platform.

We are not responsible for any tax implications on You from their participation in any Promotion.

How Does Gift a Friend Work?

Your friend to whom you have referred the super.money mobile application will earn cashback as communicated from time to time.

Please follow the below steps:

  1. Invite your friend via a meme which has an embedded personal link through the ‘Gift a Friend’ tab on the super.money app’s home page.
  2. Your friend installs the app using the link you share.
  3. Your friend creates an account and enables UPI on the super.money app.
  4. Your friend receives cashback on the super.money app.
  5. Offer is only valid if your friend is a new super.money user & subject to other terms and conditions.

Your friend must use the referral link embedded in the meme to install & meet the conditions below in order to get the cashback

The cashback amounts are subject to change & cashback earned will be based on the amounts offered in the active campaign period when the referral takes place.

What are the conditions to earning this cashback?

Your friend (Referee) has to install the super.money app using the link you shared and should be:

  • New user who has never had a super.money account.
  • An Indian phone number should be linked to your friend’s account that has not been used with someone else’s account.
  • Your friend has installed the super.money app on a new device which was never used to download the super.money app.
  • Your friend should enable super.money UPI.
  • Your friend will earn cashback only once under this offer.

You must have a valid super.money account which has a valid Indian mobile number linked to it.

TERMS AND CONDITIONS FOR GIFT A FRIEND PROGRAM

Scapic Innovations Private Limited (hereinafter referred to as “super.money” “We” “Our” “Us”) is offering cashback under its ‘Gift a friend’ offer (“Offer”) from ___________________ (00:00HRS) wherein the user has an opportunity to participate subject to the terms of this Policy mentioned below (“Policy”).

By participating in this Offer You agree to be bound by the terms and Conditions of this Policy, the Terms of Use, Privacy Policy, and other relevant documentation that are available on the super.money mobile application including any modifications, alterations, or updates that We make. This is a limited period offer and is subject to change at the sole discretion of super.money.

Eligibility for the Offer

To be eligible for the Offer You (Referrer) need to fulfill the following criteria:

  • You must have a valid account on the super.money App.

Details of the Offer

  • To participate in the Offer You must invite people who are not existing users of the super.money App (“Referee”) to download the super.money App.
  • The Referee must click on the link sent by You, successfully download the super.money App, and complete verification for UPI setup in accordance with NPCI guidelines.
  • If the Referee has downloaded the super.money App through other means, then the referee will not be eligible for cashback.
  • The device on which the Referee downloads the super.money App must be a new device (must not have installed the super.money App earlier).
  • The Referee must be a new user, and the mobile number should be an Indian mobile number that has not been registered before with any super.money account.
  • User Mobile Number should be registered in India; foreign mobile numbers are not allowed.
  • If the Referee fulfills all the above conditions, they are eligible for the referral program. The Referee needs to then complete a successful UPI transaction during the subsistence of the referral program.
  • Once the transaction is completed, the Referee will receive cashback, which will be directly added to the “cashback” section.
  • The Referee would be required to use the link provided by the Referrer to avail the aforementioned cashback. These cashbacks are subject to the referral program still being in subsistence at such a point in time.
  • Any referral and subsequent cashback are subject to authenticity and validation checks by super.money.
  • Cashback can be cashed out from the cashback tab to the Referee’s bank account.

Modification and Discretion

We reserve the right, at our sole discretion, to change, modify, add or remove portions of this Policy, including without limitation: changing the amount of cashback, modifying how You may earn and spend cashback earned, modifying the duration and expiration of cashback, minimum maximum amount of cashback that You may earn, and discontinuing the Offer entirely at any time without any prior written notice to You.

Privacy and Information

You hereby agree and understand that in order to participate in the Offer You may be required to submit personal information about You and the Customers you refer such as name, mobile number, and email address. You further agree to receive communications from us regarding your participation in the Offer. Any information collected from You or the Referred Customers as part of the Offer shall be subject to super.money's Privacy Policy.

Disqualification and Legal Action

super.money reserves the right to take any administrative and/or legal action, including but not limited to the termination of Your eligibility for the Offer or terminate Your User account or the accounts of Referred Customers if You are found:

  • Opening multiple accounts with different phone numbers for the same person/yourself in order to generate additional cashback;
  • Sending invites to people using spam, display advertising, sponsored links, unsolicited e-mails, or links on message boards or forums;
  • Attempting to take/taking unfair advantage of the Offer;
  • Using false names, impersonating other people, or otherwise providing false or misleading information to Us;
  • Offering incentives to people who do not have existing accounts with super.money to register with super.money;
  • Violating any terms of this Policy or any other terms and conditions on super.money, including but not limited to cashback in any way; or
  • Participating in the Offer in contravention with any applicable law or regulations.

You are not bound in any way to participate in the Offer and any such participation is voluntary.

Governing Law and Jurisdiction

This Policy shall be governed in accordance with the applicable laws in India. Courts at Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under this Policy.

This document is an electronic record in terms of the Information Technology Act 2000 and the Rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act 2000. This is a promotional offer (“Offer”) is being run by Scapic Innovations Private Limited (“super.money”) on the super.money mobile application (“App”), which is owned and operated by Scapic Innovations Private Limited (“super.money”).

By participating in “Pay to Chosen Name and win up to INR 100 cashback” (“Offer”), the user (“You” or “Your”) agrees to be bound by:

  • The determination of rules by super.money shall be final and super.money shall not entertain any queries or disputes in this regard.

  • Once the Winners are selected, they may be contacted 3 times by super.money over a period of 48 hours to inform him/her of the win through call, SMS and/or email. In the event that the Winner does not respond in the 3 tries, the Winner shall forfeit the Prize and a substitute Winner shall be chosen.
  • You acknowledge and confirm that You are aware of the nature of telecommunications/ internet services and that an email transmission may not be received properly and may be read or be known to any unauthorised persons. GENERAL TERMS AND CONDITIONS

  • This Contest is valid only in India (Territory) with the exception of the state of Tamil Nadu.
  • The Contest is open only to the end users who are Indian citizens. Citizens and residents of countries other than India are not eligible to participate in this Contest.
  • Prizes cannot be transferred, substituted or encashed.
  • super.money has the right to substitute the Prize(s) with other prizes of equal value, as determined by super.money in its sole discretion.
  • super.money reserves the right, at its sole discretion, to terminate, withdraw, suspend, amend, extend, modify, add or remove portions of this Contest including the prize, at any time without any prior written notice.
  • Participants are not bound in any way to participate in this Contest. Any participation is voluntary and the Contest is being made purely on a best effort basis.
  • You shall not post any content on the App which is obscene, profanity, abusive, libelous, defamatory, harassing or in any manner violate applicable laws of India. Indulgence into the anti-social/anti-national activity will lead to legal punishment as applicable in the Territory.
  • super.money, in its sole discretion, reserves the right to disqualify You from the benefits of this Contest, if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the said Contest.
  • super.money reserves the right to determine the winner and such determination shall be as per the terms of this T&C. super.money’s decision in this regard shall be final.
  • The Contest shall be subject to force majeure events rendering super.money unable to extend the Contest, for reasons beyond super.money’s control, such as, but not limited to Acts of God, acts of civil or military authorities, acts of public enemy, terrorist attacks, war, threat of war, destruction of network, strikes, lock-out, riots, civil disturbances, political disturbances, insurrections, accidents, explosions, fire, earthquake, flood, epidemics, acts of government, agencies or officers, volcano, volcanic ash, natural calamities, or any other legitimate cause restraining performance and on occurrence of such an event, the Contest may be completely or partially withdrawn at the discretion of super.money.
  • super.money shall not be responsible for any loss, injury or any other liability arising due to participation by any person in this Content.
  • The Contest is being run on ‘AS-IS’ basis and subject to change without prior notice. By participating You agree that super.money shall not be liable for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest
  • You hereby agree to indemnify and keep super.money harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney’s fee) that may be suffered by super.money as a consequence of (i) violation of terms of this T&C by You; (ii) violation of applicable laws; (iii) any action or inaction resulting in willful misconduct or negligence on Your part.
  • This T&C shall be governed in accordance with the applicable laws in India. Courts at Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under this T&C.
  • The Contest shall be subject to the Income-Tax Act, 1961 and all disbursements shall be subject to TDS, as applicable.
  • Any query regarding the Contest will be entertained only till twenty four hours post the end date of the Contest. Post such date super.money will not entertain any correspondence or communication regarding this Contest from any persons.
